A lot of times people do not like to think about what will happen after they die. Because of this, they put off making a Will. So, what happens when you don’t have a Will?

In Texas, when you don’t have a Will, the court will use the rules of intestacy (intestacy means one who has died without a Will). To find out how your property will be divided under these rules, take a look at the chart below. Please note that having a Will simplifies the process for your loved ones and is a good idea even if you only have one child or your family members generally agree on how to divide the assets. Applying the rules of intestacy may look simple but the process (such as an Determination of Heirship) is way more time consuming and expensive.
